| | | Engagement ring So it's common sense that if a couple are engaged, and they break up the engagement ring goes back to the guy if she broke it off, and she gets to keep it if he breaks it off.
Well, what about divorce? If she initiates it, does he get it? If he initiates does she get it? Or is it considered an asset, and it's value split 50/50 just as a house, car etc.? Anyone been thru this? I'm guessing my 16 year-old frineds here haven't........J/K! | | Loveforum Breaktime | | | | Loveforum also recommend - Green tea - Help in weight loss and decrease rate of getting cancer.

| | | Lloyd95-----Engagement - ring goes back to the guy.
Divorce, if it's 10pts, let her keep it. If it's a carat+, sit down and discuss. Still, why would any woman want to keep a ring that has lost its meaning, regardless of market value. I'de give it back, box and all.

| | | From what I understand, the engagement ring is basically a promise to marry, so if the promise is broken, the ring goes back to the giver. If you were married, however, the promise was filled, and she gets to keep the ring.
Lloyd, sweetie, you will probably lose this one in court based on similar cases I've read about. Maybe she would be willing to gift the ring to that beautiful little girl of yours.
Sorry.

| | | Lloyd95----This thread is about you? Thought you were asking in general. Guess you didn't sign a prenup.
30K is alot though. What's that, a 2carat? She should make an effort to return it. Than if you're generous, you can say "No dear, you may keep it". Only than can she go out and get it reset.

| | I don't want to say whether or not it is about me; I was going to use the $$$ to buy a ring for when I go out and attempt to sweep Shh! off of her feet. | |

| | | damn! $30k!? good lord, that's a lot of money ...
anyhow, i think shh! is right on this one ... the engagement ring represents a verbal agreement of some sort and since the marriage did happen, then the ring is hers to pawn or sell on ebay.
although, my ex gf didn't give me my ring back, but it wasn't worth it to me to take it to a small claims court ...

| | | Legally - It gets split 50/50 and is considered an asset in the case of marriage.
Verbal agreements, as long as both parties are willing to accept and admit that they made the verbal agreement, is a legal binding contract in the state of California.
